Insider Info From A Former Spokane Domestic Violence Deputy Prosecutor, On How To Get Home Faster, After Being Charged With Domestic Violence in Spokane...

FROM THE DESK OF: Deanna Crull, Attorney at Law, and Former DV Deputy Prosecutor

Dear Friend,

Relationships get complicated and families suffer stress for lots of reasons.

Pressure builds…there’s an argument…and then boom…cops and handcuffs…your entire world seems to go upside down. You’re in a place that you’d never thought you’d be...

Now you’re probably out of jail with a no-contact-order (NCO) that says you can’t go home or talk to anyone. You’re feeling completely isolated and alone. It’s a shitty feeling to say the least…

You just want to go home and get things patched up…

But how do you do that?

YOU MUST GET THAT NO-CONTACT-ORDER DROPPED TO GET BACK HOME

The good news is that the restraining order can probably be lifted. The question is how long will it take?

Most courts want to keep it in place for at 30 days as a “cooling off period”. Now, do we help get them removed before 30-days? Yes! But it takes some work and coordination, and there are no guarantees.

However, if your significant other or whoever doesn’t want the restraining order lifted, it will be much harder. Also, if you have some domestic violence history the courts will be less willing to remove it. Not impossible, but it will be harder.

DON’T DO THIS OR YOU’LL SCREW UP YOUR CHANCES OF GETTING HOME AND SETTLING YOUR CASE

Do Not Violate The NCO: the quickest way to piss a judge off is to violate the restraining order. This is hard, because your significant other is probably calling and texting. Just know if you get caught, its going to make it really hard to get the NCO lifted. It will also make it harder to settle your case in a favorable way.

If you are in a very volatile relationship where mental health issues and/or substance abuse issues are a factor, then getting hit with an NCO violation is greater. How so? Some of these folks are very good at getting what they want, and on top of that you’re probably feeling isolated. The problem is when the other person tends to be volatile. One minute all is good, and the next you’re in the backseat of a cop car again.

It’s just not a good idea to violate these orders. We can help you have some type of communication without violating the order. Just don’t try to take care of it yourself.

A STRATEGY FOR EACH KIND OF SITUATION

What Describes Your Situation? We generally see a few different situations like this:

  1. Folks had some drinks and things went sideways…
  2. High-stress family situations that have been building…
  3. Relationships that have finally failed…

The type of situation that you’re coming from can really dictate the best strategies for you to proceed. If the parties are relatively calm and just wanting to get back together, it’s really just a matter of patience to work this problem out through the courts.

If things are volatile, you will really need some advice on how to manage things, whether you want to continue the relationship or not.

DOMESTIC VIOLENCE CHARGES CAN HAVE PROFOUNDLY NEGATIVE EFFECTS ON YOUR FUTURE

Never take a DV (domestic violence) case lightly. These types of convictions can affect gun rights, housing availability, child custody, certain professional licenses (nursing), and things like coaching and volunteering…. The list is longer, but you get the point.
